Terms of Use

These terms govern the relationship between you and the Belmenu platform when you use the service. By using the platform or creating an account, you acknowledge that you have read, understood, and fully agreed to these terms.

Definitions

  • "The platform" or "the service": the Belmenu service for creating and managing a digital restaurant menu, including the dashboard, the public restaurant link, and its published pages.
  • "The provider" or "we": the operators of the Belmenu platform and the party responsible for running it and providing it to you.
  • "The user" or "you": any individual or legal entity that creates an account or uses the platform.
  • "Content": any text, images, prices, or data you enter or upload through your account.

Scope of service

The platform provides tools to build a complete digital menu for your restaurant, including managing categories, products, prices, and images, customizing your branding, publishing the menu through a subdomain or custom domain, and managing subscription and billing. We may develop, modify, or discontinue features at any time in the interest of the continuity and quality of the service.

Eligibility

You must have reached the legal age of majority in your country of residence and have the legal capacity to enter into contracts. If you are acting on behalf of a business, you confirm you are authorized to bind that business, and your obligations extend to it.

Account and credentials responsibility

  • You are responsible for providing accurate, up-to-date information when creating your account and in your restaurant profile.
  • You are solely responsible for keeping your sign-in credentials (email and password) confidential and for all activity that takes place under your account.
  • You must notify us as soon as you suspect any unauthorized use of your account or any related security incident.
  • We may suspend or terminate any account we determine is being used in a violating or fraudulent way.

Free trial, subscription, and billing

  • The platform offers a fixed-duration free trial during which you may use the available features to evaluate the service before committing to a subscription.
  • The plan consists of a one-time activation fee plus an annual maintenance and hosting fee, both clearly disclosed on the pricing page and at checkout.
  • Fees are paid upfront in the currency shown at checkout. Whether fees include or exclude VAT is shown at the time of payment.
  • If the annual renewal fee is overdue, we may suspend access to the dashboard or temporarily hide the menu until outstanding amounts are settled.
  • Fees paid are non-refundable except where consumer protection laws require otherwise, or in cases of a continuing material defect that prevents you from using the service and that we have been unable to resolve within a reasonable time.
  • Payments are processed through authorized payment providers, and card details are not stored on our servers.

Content and user responsibility

You retain full ownership of the content you upload (images, prices, product descriptions, logos, and similar). You grant us a limited license to host, display, store, and transmit it as needed to operate the service.

You acknowledge and warrant that:

  • You hold the rights necessary for all content you publish, and it does not infringe the rights of any third party.
  • Prices, offers, and descriptions are accurate and not misleading, and you comply with any restaurant-related regulations in the country where you operate.
  • You will not upload content that violates public decency, incites hatred, or breaches applicable laws.

Prohibited use

You may not use the platform in any of the following ways:

  • Attempting unauthorized access to systems or other accounts, or bypassing security measures.
  • Reverse engineering, copying, or reselling the platform in whole or in part without our written permission.
  • Uploading malware or harmful code, or generating unusual traffic volumes intended to affect the stability of the service.
  • Using the platform to promote unlawful activities or products prohibited by law.
  • Infringing the intellectual property rights or trademarks of others.

Intellectual property

All intellectual property rights related to the platform itself, including source code, designs, interfaces, logos, and the "Belmenu" trademark, belong exclusively to the provider. Using the service does not grant you any ownership rights in these elements, and you may not copy or reuse them outside the scope of the service.

Availability and changes to the service

We aim to keep the service available with the highest reasonable stability, but the platform is provided on an "as is" and "as available" basis. Temporary downtime may occur for maintenance, updates, or reasons outside our control. We make reasonable efforts to give advance notice for scheduled downtime. We may update, merge, or retire features as the product evolves.

Disclaimer of warranties

To the extent permitted by applicable law, we do not provide any express or implied warranty of fitness for a particular purpose, freedom from errors or interruptions, or any specific commercial outcome you may expect. You are responsible for evaluating whether the service is suitable for your restaurant's needs.

Limitation of liability

To the extent permitted by applicable law, the provider is not liable for any indirect or consequential damages, including (without limitation) loss of profits, loss of business opportunities, loss of reputation, or loss of data, arising from your use of, or inability to use, the platform.

In any event, our total aggregate liability to you will not exceed the total amount you actually paid to the platform during the twelve months immediately preceding the event giving rise to the claim.

Indemnification

You agree to indemnify and defend us against any claims, losses, or expenses (including reasonable legal fees) arising out of your breach of these terms, of third-party rights, or of applicable laws, or arising out of the content you publish through the platform.

Suspension and termination

  • You may end your subscription at any time through the dashboard or by contacting support.
  • We may suspend or terminate your account if you breach these terms, fail to pay amounts due, or where there is reasonable suspicion of fraudulent activity or activity harmful to the platform or its users.
  • Upon termination, access to the service ends, and you are allowed a reasonable period to export your data before deletion, subject to our legal retention obligations.

Force majeure

Neither party is considered in breach of its obligations if performance is prevented by a cause beyond its reasonable control, such as natural disasters, major outages of essential internet services, large-scale cyberattacks, or emergency government decisions.

Changes to the terms

We may update these terms from time to time. The last updated date will always appear at the top of the page, and we will make reasonable efforts to notify you of any material change. Continued use of the service after an update constitutes acceptance of the updated version.

Governing law and dispute resolution

These terms are governed by the laws and regulations applicable to the operation of the Belmenu platform, with regard to any mandatory consumer rules that apply to you in your place of residence. We will first try to resolve any dispute amicably through official contact channels. If that is not possible, the dispute will be referred to the competent judicial bodies or arbitration forums in accordance with applicable laws.

General provisions

  • If any clause of these terms is found unenforceable, the remaining clauses are not affected.
  • Failure to enforce any right does not mean we waive it.
  • You may not assign your rights or obligations under these terms without our written consent. We may assign them to a successor or affiliated entity.
